Adelaide conveyancer lodging a caveat on a property title

Caveats & Workers' Liens Adelaide

At Trevor White Conveyancers, we've helped South Australians protect their interest in property since 1991. If you have a legal claim over a property, lodging a caveat or workers' lien stops it being sold or transferred without your knowledge. We advise whether you have grounds, prepare the documents, and lodge them correctly with Land Services SA.

From our office in the Adelaide CBD, we make it simple and fast.

What is a caveat on a property?

A caveat is a legal notice recorded on a property's title that warns others you have an interest in it. Once a caveat is lodged, the property generally cannot be sold or transferred until it is resolved. People lodge a caveat on a property to protect an interest, such as an unpaid debt, a contribution to the purchase price, or a right under an agreement.

How to lodge a caveat

Lodging a caveat in South Australia requires a genuine legal interest in the property, known as a caveatable interest. Caveats are recorded on the certificate of title under the Real Property Act 1886 (SA). We check whether you have grounds, prepare the caveat, and lodge it with Land Services SA. Lodging a caveat without a proper interest can expose you to costs, so it is worth getting advice first.

Workers' liens

If you have carried out work on a property and have not been paid, you may be able to lodge a workers' lien under the Worker's Liens Act 1893 (SA) to secure what you are owed. Workers' liens are strict on time limits and requirements, so early advice matters. We assess your situation and lodge the lien correctly.

Removing or withdrawing a caveat

If a caveat has been lodged against your property and you believe it is invalid, we can advise on removing or challenging it. We can also withdraw a caveat once the matter is resolved. In South Australia there are set processes and timeframes for this, and we manage them for you.

How long does a caveat last in South Australia?

+
A caveat generally stays on the title until it is withdrawn, removed, or lapses after a formal challenge. We advise on the timeframes that apply to your situation.

Can you sell a property with a caveat on it?

Generally not until the caveat is resolved, as it prevents the transfer of ownership. The caveat usually needs to be withdrawn or removed first, which we can help with.

What is a workers' lien?
